1. Who we are and scope
DeltaForge is published by DeltaForgeAI Inc. ("we", "us"), the controller of the personal data described here. You can reach us at [email protected], or by post at 8903 Glades Rd, Ste A8 # 4070, Boca Raton, Florida 33434.
This notice covers the DeltaForge desktop app, our licensing and store services, and the deltaforge.ai website. The website sets no cookies and runs no analytics; ordinary server logs (IP address, browser information, and the pages requested) are used only to operate and secure the site.
2. Personal data we collect
- License-acceptance records — which license documents and versions you accepted, a device identifier, the date and time, and the IP address and browser or app information observed on the request.
- Device licensing data — a device identifier and license status.
- Feedback — the text and categories you submit, the app version, your operating system, a device identifier, the date and time, the IP address, and an email address only if you choose to provide one.
- Store account data — your email address, sign-in and session data, and the association between your account and your device.
- Payment data — processed by Stripe, Inc. Card details are entered on Stripe-hosted pages and are never received by us. We hold Stripe customer and subscription identifiers and your subscription status.
3. Purposes and lawful bases
- Performance of a contract — providing licensing, store accounts, and subscriptions.
- Legitimate interests — evidencing your acceptance of the license terms, security and abuse prevention, and acting on feedback you send us.
- Legal obligation — retaining business and tax records.
Acceptance of the license agreements is a condition of using DeltaForge. If you decline, no license is granted.
We do not sell or share personal information, do not use it for advertising, and the desktop app collects no telemetry or analytics.
4. Recipients and international transfers
We use Cloudflare, Inc. (hosting) and Stripe, Inc. (payments), each acting on our behalf and on our instructions as our processor. We disclose personal data to no other recipients except as required by law.
Your data may be processed in the United States and elsewhere. For transfers out of the EEA or the UK we rely on the Standard Contractual Clauses; a copy of the applicable safeguards is available on request at [email protected].
5. Retention
- License-acceptance records — for the life of your license and thereafter for the applicable limitation period. They are retained as proof of consent even after account deletion.
- Feedback — 12 months.
- Account and billing records — the life of the account plus the statutory retention period for business and tax records.
- On account deletion we keep a minimal record that the deletion was performed, containing no personal data beyond a pseudonymous identifier.
When personal data is deleted from our active systems, residual copies may persist in our encrypted backups until those backups expire in the ordinary course. Such copies are put beyond use — we do not access or restore them for any purpose — and are permanently deleted when the backup cycle completes.
6. Your rights
Depending on where you live, you may have the right to access, rectify, erase, restrict or object to the processing of your personal data, to receive a portable copy, and not to be discriminated against for exercising these rights. You may also lodge a complaint with your data protection supervisory authority (in the UK, the Information Commissioner's Office).
If you have a store account, you can delete it yourself from within your account. All other requests go to [email protected]; we will verify your identity before acting on a request. For California purposes, the data described above falls into the "identifiers" and "internet or other electronic network activity" categories, and we have not sold or shared personal information in the preceding 12 months.
License-acceptance records may be retained despite an erasure request where they are needed to establish, exercise, or defend legal claims.
7. Children
DeltaForge is not directed to children. You must be at least the age of majority (or the age of digital consent, if higher) in your jurisdiction, and we do not knowingly collect personal data from children.
8. Changes to this notice
We may update this notice from time to time. The "Last updated" date at the top shows the current version. Material changes affecting the desktop app will be presented in the app for your re-acceptance.
